Quantification of Damages in Breach of Fiduciary Case Involving an Industrial Products Company
Matter involving the quantification of damages resulting from a breach of fiduciary duty by a former employee that left and started their own industrial products business.
When a former employee of an industrial products company started a competing business, we were called in by the company to quantify the losses associated with a breach of fiduciary duty claim. Our work involved identifying, collecting, and analyzing the relevant financial documents, determining which customers had purchased products from the competing business, and assessing the most reasonable assumptions upon which to estimate the company’s losses.
We prepared an expert report quantifying the company’s losses and provided expert testimony at the arbitration. The Arbitrator found that the former employee had breached his duty towards his former company and awarded damages based on the conclusions in our report.
