Quantification of Losses Pursuant to Business Interruption Claim
An insured party and the insurer had not reached agreement on the quantum of loss resulting from a business interruption claim and the matter proceeded to litigation. CHS was retained to review the expert reports prepared by the claimant’s and insurer’s experts in respect of the alleged losses.
Our analysis identified the key differences between the experts’ respective reports and focused on these particular areas. The case required significant analysis of issues related to the determination of the indemnity period, determining the heads of loss and evaluating the different aspects of the claimant’s business losses including the loss of clients and incurring various additional operating expenses. Our work also involved assessing the claimant’s financial accounting forecasts and considering the related estimates that impacted the claim. The matter ultimately settled prior to trial.
