The Empire Life Insurance Company ats/v. Thibault et al
2012 ONSC 5387This action initially involved a claim by an insurance agent against an insurance company to honour the purported cash surrender values on certain legacy policies he held. However, the insurance company disputed the claims as unsupported fabrications.
Our analyses encompassed the tracings of 20,000 deposit and withdrawal accounting entries over a 17-year period to determine the proper cash values of the policies in question and/or in the name of the agent. Our analyses required the identification and consolidation of relevant records from the company and a legacy acquisition which encompassed a variety of computer records, microfiches and hard copies.
The trial judge accepted our quantification findings as to the true negative position of the policies’ cash values.
