Prem Lobo participated in a panel discussion for the CBA’s Competition Law and Foreign Investment Review Section
CHS Principal Prem Lobo participated in a panel discussion on February 12, 2025 for the Canadian Bar Association's Competition Law and Foreign Investment Review Section, on the topic “Hand it Over: Disgorgement Remedies in the Canadian Competition Landscape” . The panel discussed the impending impact of Bill C-59, which will make it easier for private applicants to obtain leave from the Competition Tribunal to bring a private action for abuse of dominance and create a disgorgement remedy.
Prem’s comments focused on the methodology, information needed and practical requirements for calculating an accounting of profits under a disgorgement remedy as compared to damages previously.
